26780065, The study of the law concerning the children's relocation after parental separation: considering where the children's best interests lie, The primary aim of this study is to come up with legislative proposals concerning the child’s relocation, especially after parental separation. Under the current Japanese family law, we have no resolution system of relocation dispute. However, if we are to introduce shared parental responsibility(authority) or shared parenting law after parental divorce, it should involve the system of the non-resident parent opposing to the resident parent and child's relocation.;The findings of this study suggest that we should develop such system with a view to ensuring the child's interests of having meaningful relationship with both parents, rather than shared parental rights to determine child's residence. At the same time, we should not put too much emphasis on consequent restrictions on relocation. The new law system should rather prescribe the standards for permitting relocation so that parents can try to make consent on child's residence by themselves and realize their child's interests.
24830091, The Legal Analysis of the Interests of Stepchildren: Exploring the Concept of 'Parent' and 'Marriage', This study examined the legal status of step-relationship in Japan, especially using both socio-legal and comparative approaches. The analysis suggests some limitations of the Japanese law system in serving the interests of children through the dynamic changes of family relationships following parental divorce, remarriage and redivorce. Under the current system, adoption is the only available means of conferring on stepparents a formal status as the children's carer. However, a strong pressure to conform to the model of standard marriage family, represented by one couple and "their children", is deeply rooted in the Japanese law as well as society. This pressure turns adoption into no more than an accessory to parental remarriage. If we attempt to explore this issue further for the purpose of considering a desirable form of the law system on stepfamilies, it should be helpful if we tackle the question of how far and in what way the standard marriage family model can step back.
