15H03292, Synthetic resarch on the modernization of British Constitution, As a referendum on the membership as the European Community of United Kingdom in 2016, UK decided to leave the EU.Institutions of United Kingdom constitution had been influenced by EU leagal system in many aspect. So, the quit from EU imposes the British Constitution huge changes and re-arrangement. To understand and estimate the current changes and argument on British Constitution, our resarch team held international seminar on so called Brexit, and are now publishing the resarch papers on the matter.
23330012, Theoretical and empirical study of the Westminster model constitution of post-democracy circumstances, The study was proceeded to examine the changes of the constitutional changes in the UK under the coalition government since 2010, in the light of 'Post-Democracy' situation that meant 'degradation of democracy'. Each research member had his/her own theme to study the 'Westminster model' constitution, and the research organization totally consolidated and intensified the achievement by research meetings. We could got the results to elucidate the recent changes in the 'Westminster model' constitution.;In addition, we held two times a "Japanese-UK Constitution Seminar" in Japan, the first time, invited a constitutional professor from the Univ. of London in 2012, the other, in the King's college London in 2013. We got well achievements in research exchange, and built the foundation of further international joint research.;The research results has already summarized in the booklet, and we will publish a book next year.
21330005, To Revitalize Democracy Against the Tide of the Globalization : Comparative Study of Constitutional Theory and Politics, By the comparative study of constitutional law and the analysis of the constitutional theories in Japan and abroad, we make it clear that(1) Almost all advanced countries have some difficulties in democratic process under the historical conditions of" Post-democracy"(Colin Crouch), but(2) the problems could differ according to the political conditions, constitutional arrangements and so on. So we should have enough attention to the problems made by“Post-democracy", but also, we should not overestimate that theory.;We also show that the theory of“legal constitutionalism=liberal democracy", which is now mainstream theory in Japan and other western constitutional democracies, has difficulty in dealing with the challenge of serious gaps between the wealth and the poor, which is getting more and more serious today, both domestically and globally.;So we could tell that the reconstruction of the democratic constitutional theory is necessary today, and we should study the theory of“public sphere"not only in abstract or philosophical level, but also in the context of the constitutional arrangements and political institutions in each country. In this research, we have done some of that study.
18330008, Reconsideration on the Westminster Model Constitutions and the Future of Constitutionalism
12420005, Comprehensive Study On The New Labour And The Constitutional Reform In Uk, Through this research we intended to study comprehensively the "Constitutional Reform" by the Blair Government of New Labour in UK which had appeared by the general election in 1997, with viewing the 21st century deployment of the modern constitutionalism and studying the philosophy of the "Third Way" of New Labour. We have got a big result by this three-year research.;Although this research was joint research by 14 researchers from which an affiliation endowed institution differs, it was able to clarify each research assignment subject and was able to carry them out as one synthetic research by close cooperation of them and especially cooperation of a research representative and other research organizers. We had joint meetings to study and exchange information at every time of national academic meetings in spring and autumn. We had three-day camp study meeting every August, to check the progress of each research and to exchange information. And three persons were dispatched to Britain every year for researching and gathering information of the sistuation of the "Constitutional Reform", and we had chances to exchange with staffs in charge of governmental organizations, political parties, think tanks and so on.;The productions of this research were twelve books, twenty-five academic articles and eleven academic reports. Concentration of the result about each research task is summarized in this report..;The big result of this research would be in having caught the British constitutional reform which is advancing simultaneously, with the way of comparative constitution study in the view of the 21st century-deployment of modern constitutionalism, and many researchers having been united and studied this synthetically. Moreover, the respectively big results were induced about each field of constitutional reform.
